Terms of Service
Last updated: 2 July 2026
Template notice: this page is a drafting starting point, not legal advice. Replace every bracketed placeholder (legal entity name, jurisdiction, contact details) and have it reviewed by a qualified lawyer for your country before relying on it — especially the consumer-rights, refund, and liability sections, which vary by jurisdiction.
These Terms of Service ("Terms") govern your access to and use of GenClear (the "Service"), operated by [YOUR LEGAL ENTITY NAME], a [company / sole proprietorship] based in [YOUR COUNTRY / JURISDICTION] ("we", "us"). By creating an account, uploading a file, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. What the Service does
GenClear accepts a video file you upload, automatically detects a supported watermark (currently Gemini and Veo watermarks), and processes it using an automated tool to produce a version of your file with the watermark removed. Processing happens in an isolated sandbox with no outbound internet access. We do not use artificial-intelligence inpainting or generative fill — the tool reverses the watermark's alpha blend mathematically.
2. Eligibility and accounts
- You must be at least 16 years old (or the age of digital consent in your country, if higher) to create an account.
- You are responsible for keeping your password and any API key confidential, and for all activity under your account.
- You may register with an email/password or via Google sign-in. You must provide accurate information.
- We may suspend or disable an account that violates these Terms, is used fraudulently, or presents a security risk.
3. Your content and your responsibility for it
You retain all ownership rights in the video files you upload ("Your Content"). By uploading, you grant us a limited, non-exclusive license to store, process, and return Your Content solely to provide the Service to you. We do not claim ownership of Your Content and do not use it to train any model.
You represent and warrant that:
- You own Your Content or otherwise have the necessary rights and permissions to upload it and to have its watermark removed;
- Your use of the Service does not infringe any third party's copyright, trademark, privacy, or other rights;
- you are solely responsible for ensuring that removing a watermark from content you did not originally create — including AI-generated content — complies with the terms of service of the platform that generated it (for example, Google's Gemini/Veo terms) and with the law applicable to you. We make no representation that doing so is permitted in every case, and we disclaim liability for your choice to do so.
4. Prohibited use
You agree not to use the Service to:
- upload content you do not have the right to process, including content that infringes someone else's intellectual property or privacy rights;
- upload unlawful content, including child sexual abuse material, non-consensual intimate imagery, or content that facilitates fraud, harassment, or violence;
- attempt to circumvent rate limits, credit limits, or security controls, or to reverse-engineer, scrape, or overload the Service;
- resell or sublicense API access without our prior written consent;
- use the Service in a way that violates applicable export-control, sanctions, or other laws.
We may remove content, refuse processing, or terminate accounts that violate this section, and may report unlawful content (such as CSAM) to the relevant authorities as required by law.
5. Free tier, credits, and paid subscriptions
- Anonymous visitors may process a limited number of files for free, subject to rate limits, without an account.
- Registered free accounts receive a monthly credit allowance that resets on the 1st of each month and does not roll over.
- Paid Pro subscriptions are billed monthly or yearly in advance via our payment processor, Stripe, and renew automatically until cancelled. Prices are shown on our pricing page and may change with notice; changes apply from your next renewal.
- You can cancel a subscription at any time from your account's billing portal; cancellation takes effect at the end of the current billing period.
- See our Refund Policy for cancellations and refunds.
6. File storage and deletion
Uploaded files and processed results are stored only long enough to let you download them, then automatically deleted. Typical retention windows are: anonymous/guest uploads — 24 hours; registered free-tier results — 48 hours; Pro-tier results — as little as 1 hour after processing completes. We may retain a short-lived, content-addressed cache (keyed to a hash of your file, not to your identity) so that re-uploading an identical file returns an instant result; cache entries are purged after a limited period. See our Privacy Policy for details.
7. Service availability
The Service is provided on a best-effort basis. We do not guarantee uninterrupted availability, a specific processing time, or that every watermark type will be detected — some files may be marked "skipped" if no supported watermark is found, in which case any credit spent is refunded automatically. We may modify, suspend, or discontinue features at any time.
8. API access
If you generate an API key, you are responsible for securing it and for all requests made with it. We may throttle, rate-limit, or revoke API access that abuses the Service or violates these Terms.
9. Our intellectual property
The Service, including its software, design, and branding, is owned by us or our licensors and is protected by intellectual-property law. These Terms do not grant you any rights to our trademarks or branding. The underlying watermark-removal engine is built on open-source components; see the credits linked in our footer.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. Nothing in these Terms limits any statutory rights you have as a consumer that cannot be excluded under the law of your country of residence.
11. Limitation of liability
To the maximum extent permitted by law, GenClear and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or business, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose, or [€100 / a fixed cap of your choice], whichever is greater. This section does not limit liability that cannot be limited under applicable law (for example, liability for death, personal injury, or fraud).
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the security or integrity of the Service. On termination, your stored files may be deleted immediately.
13. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will make reasonable efforts to notify registered users (for example, by email or an in-app notice) before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
14. Governing law and disputes
These Terms are governed by the laws of [YOUR GOVERNING LAW / COUNTRY], without regard to conflict-of-law principles, unless a mandatory consumer-protection law of your country of residence grants you additional rights or a different forum. Any dispute will be resolved in the courts of [YOUR JURISDICTION / VENUE], subject to any mandatory consumer rights you have to bring proceedings in your own country.
